Terms of service

The service is provided by «pełna nazwa spółki», registered at «ulica, kod pocztowy, miasto», «KRS / NIP / REGON», referred to below as “Omotia”.

These terms are made available free of charge in a form that lets you download, save and print them. They constitute terms for the provision of services by electronic means under Polish law.

Omotia is a virtual fitting room. You upload one full-height photo, pick a garment from a partner shop's catalogue, and our system generates an image of you wearing it.

The service runs in the browser and requires no installation. Browsing clothes and generating try-ons is free.

Omotia is not a shop. We do not sell clothes, do not take payment for them, and do not fulfil orders.

Omotia may be used by anyone aged 16 or over with an internet-connected device and an up-to-date browser.

Generating try-ons requires an account. When you create one, you give a genuine email address and are responsible for keeping your password confidential.

The photo remains yours. We acquire no copyright in it.

By uploading it, you grant us a limited, non-exclusive, revocable licence to process it solely in order to generate and display your try-ons. The licence ends when you delete the photo.

By uploading a photo, you confirm that:

• it depicts you, or a person who has consented to their likeness being used this way,
• you have the right to upload it and are not infringing anyone else's rights,
• it contains nothing unlawful, offensive or pornographic.

Uploading photos of other people without their consent is prohibited.

Try-ons are visualizations generated by artificial intelligence and are indicative only.

The cut, size, colour, texture and drape shown in a generated image may differ from the real product. A try-on is not a guarantee of fit, is not a size recommendation, and does not replace the information provided by the shop.

Every generated image is visibly labelled as produced by artificial intelligence.

The clothes shown in Omotia come from the catalogues of third-party online shops, made available through affiliate networks.

When you click a product you are taken to the shop's site, and it is with the shop that you enter into the contract of sale. The shop is responsible for price, availability, product description, delivery, returns and complaints about the goods.

For some purchases made after visiting from Omotia, we may receive a commission from the shop or the affiliate network. This does not affect the price you pay.

We make every effort to keep product data current, but we are not responsible for changes made on the shop's side.

When using Omotia, you must not:

• upload photos of other people without their consent,
• upload content that is unlawful, offensive, pornographic or infringes the rights of others,
• use generated images to mislead anyone into believing they are real photographs,
• remove or obscure the label identifying an image as generated,
• disrupt the service, including large-scale automated data collection,
• circumvent security measures or service limits.

Breaching these rules may result in your account being suspended or deleted.

We aim to keep Omotia running without interruption, but we do not guarantee constant availability. The service may be unavailable due to maintenance, failures, or causes beyond our control.

We may develop, change and retire individual features. We give advance notice of significant changes that reduce the scope of the service.

We are liable for failure to perform or improper performance of the service on the terms set out in applicable law.

We are not liable for purchasing decisions made on the basis of a try-on, for differences between a visualization and the real product, or for the conduct of partner shops.

Nothing in these terms limits consumer rights arising from mandatory provisions of law.

You can raise a complaint about how Omotia works by writing to support@omotia.pl.

Describe the problem and give the email address linked to your account. We respond within 14 days of receiving the complaint.

Complaints about the goods themselves should go to the shop where they were bought.

The contract for electronic services is concluded for an indefinite period, and you can end it at any time by deleting your account, without giving a reason and at no cost.

If you are a consumer, you also have the statutory right to withdraw from the contract within 14 days of entering into it. A statement sent to support@omotia.pl is enough.

Because the service is free, withdrawal involves no financial settlement.

We may suspend or delete an account if you seriously breach these terms, in particular by uploading other people's photos without consent, or unlawful content.

Before we do, we will tell you why and, where the nature of the breach allows, give you the chance to stop. You can appeal our decision by writing to support@omotia.pl.

These terms are governed by Polish law, provided that this does not deprive you of the protection of mandatory provisions of the law of your country of habitual residence.

If you are a consumer, you may use out-of-court dispute resolution, for example the assistance of a district or municipal consumer ombudsman, or mediation at the regional Trade Inspection Authority.

We may change these terms for valid reasons: changes in the law, in the scope of the service, or in how it is provided.

We will notify signed-in users by email at least 14 days before a change takes effect. If you do not agree to it, you can delete your account before that date.
