Privacy policy
This policy explains what personal data we collect, why we process it, and what rights you have. We write it as plainly as we can, without needless legal jargon.
Omotia is a virtual fitting room. We process your photo to show you an image of yourself wearing the clothes you picked. That is the only reason we need it.
1. Who controls your data
The controller of your personal data is «pełna nazwa spółki», registered at «ulica, kod pocztowy, miasto», «KRS / NIP / REGON».
For anything concerning personal data or this policy, write to support@omotia.pl.
2. What data we collect
We collect only what the fitting room needs to work:
- Account data: your email address and a hashed password, used to sign you in and link try-ons to you.
- Your photo: the single full-height photo you upload yourself.
- Generated try-ons: images produced from your photo and a product photo.
- Technical data: IP address and basic browser information, written to server logs for security reasons.
We collect no payment data. You complete purchases in the partner shop, not in Omotia.
3. Why we process data, and on what basis
- Providing the service: generating try-ons, running your account and showing you your history. Basis: performance of the contract (Art. 6(1)(b) GDPR).
- Processing your photo: on the basis of your explicit consent, given when you upload it (Art. 6(1)(a) GDPR). You can withdraw that consent at any time by deleting the photo.
- Security and upkeep: logs, abuse prevention, error diagnostics. Basis: our legitimate interest (Art. 6(1)(f) GDPR).
- Legal obligations: handling complaints and requests, and accounting. Basis: Art. 6(1)(c) GDPR.
4. Your photo
We treat the photo you upload with particular care.
- We use it solely to generate your try-ons. We do not publish it, do not share it with other users, and do not sell it to anyone.
- We do not use it for biometric identification or face recognition. We do not derive a biometric template from it.
- We do not use it to train artificial-intelligence models.
- You can delete it at any time from your account. Deleting the photo also deletes the try-ons generated from it.
5. How long we keep data
- Your photo and try-ons: until you delete them, or until your account is deleted.
- Account data: for as long as the account exists. After deletion we erase it without undue delay, at the latest within 30 days.
- Technical logs: up to 12 months.
- Data needed to defend against claims or required by law: for the limitation period or the period the law prescribes.
6. Who we share data with
We do not sell your data. We entrust it only to the providers the service genuinely needs, under data-processing agreements:
- providers of server infrastructure and file storage,
- the provider of the technology that generates try-ons,
- the transactional email provider, for messages such as a password-reset link.
Each of them processes data only on our documented instructions and only to the extent necessary.
7. Data stays in the European Union
Your photos and try-ons are stored on servers located in the European Union.
If any provider were in future to process data outside the European Economic Area, it would happen only under the mechanisms set out in Chapter V of the GDPR, that is an adequacy decision or standard contractual clauses. We would update this policy before it did.
8. Your rights
Under the GDPR you have the right to:
- access your data and receive a copy of it,
- have inaccurate data corrected,
- have your data erased, the “right to be forgotten”,
- restrict processing,
- port your data to another controller,
- object to processing based on our legitimate interest,
- withdraw consent at any time, without affecting the lawfulness of processing carried out beforehand.
Most of this you can do yourself in your account settings. For anything else, write to support@omotia.pl. We respond without undue delay, at the latest within one month.
You also have the right to lodge a complaint with the President of the Personal Data Protection Office (Prezes Urzędu Ochrony Danych Osobowych), ul. Stawki 2, 00-193 Warsaw, Poland, if you believe we process your data unlawfully.
9. Cookies and analytics
This page sets no cookies, collects no visit statistics, and makes no requests to third-party services. Typefaces are served from our own server, so not even they reveal your IP address to anyone.
In the application itself we use only what it needs to function, chiefly keeping you signed in. We use no marketing or tracking cookies.
10. Artificial intelligence and automated decisions
Try-ons are generated by an AI model that combines your photo with a product photo. Every such image is visibly labelled as generated.
We do not take decisions about you based solely on automated processing that would produce legal effects or similarly significantly affect you. We do not profile you for marketing purposes.
11. Age of users
Omotia is intended for people aged 16 and over. We do not direct the service at children and do not knowingly collect their data. If we learn that an account was created by someone younger, we will delete it along with the data.
12. Changes to this policy
If we change how we process data, we will update this policy and change the date shown at the top of the page. We will notify signed-in users of significant changes by email in advance.
